Key settlement terms affecting consumers include the following:</strong></span></p>
<p><span style="font-size: 16px;"><em><strong>Written Agreements with Buyers</strong></em></span></p>
<ul>
<li>Utah REALTORS® are already using written, transparent agency forms with their buyer clients as required by the settlement. While this part of the settlement will be a significant change across the country, in Utah we’ve required this for decades.</li>
<li>The practical change we’ll see in Utah is that buyers will need to sign this agreement with their agent before touring homes.</li>
</ul>
<p><span style="font-size: 16px;"><em><strong>Disclosures to Sellers</strong></em></span></p>
<ul>
<li>Utah REALTORS® are already providing the seller disclosures required under the settlement The Utah Association of REALTORS® lisIng agreement discloses to the seller that the lisIng broker may share an amount of their compensation with a buyer broker. The seller signs and consents to this. The agreement also explains that brokerage fees are not set.</li>
<li>There is no practical change here as the se+lement’s required disclosures are already included in the standard listing agreement used in Utah. There will be some minor changes to the listIng agreement to make sure it aligns with the settlement.</li>
</ul>
<p><span style="font-size: 16px;"><em><strong>Compensation Sharing</strong></em></span></p>
<ul>
<li>While listing brokers will no longer offer to offset the cost of the buyer’s agent on the MLS and in the published MLS listing, listIng brokers may continue to offset the cost of the buyer’s representation in negotiations that take place off the MLS.</li>
</ul>
<p>&nbsp;</p>
<p><span style="font-size: 16px;"><em><strong>Negotiation and Compensation &#8211; </strong></em></span><strong>Buyers and sellers will continue to have opinions regarding how they work with a REALTOR® and negotiate compensation.</strong></p>

<li>Buyers will continue to have the option to ask the listing broker to offset the cost of their buyer agent through a compensation-sharing agreement. The practical change is that compensation-sharing agreements will now be negotiated off the MLS. In other words, the listing agent can still offer compensation to the buyer agent, but the offer will no longer be published in the MLS listing. This already happens in many transactions. Offers of compensation increase affordability for buyers, and sellers benefit because the offer to offset the buyer’s cost of representation makes the<br />home more attractive to buyers.</li>
<li>Buyers will continue to have the option to directly ask the seller to pay for the cost of their buyer agent during the real estate negotiation.</li>
<li>Buyers will continue to have the option to pay their agent directly.</li>
<li>Buyers will continue to have the option to use a combination of Options 1, 2, and 3.</li>
</ol>

<ul>
<li>Utah buyers and sellers have many choices for real estate services. Examples include full service, flat fee, for sale by owner, etc.</li>
<li>There is no set or standard commission. CompensaIon is and will remain entirely negotiable between agents and their clients.</li>
<li>Utah consumers will continue to have real estate choices and will continue to negotiate the cost based on the value and services provided.</li>

<h4><strong>Home Prices Are Expected To Climb Moderately</strong></h4>

<p>The reason for continued appreciation? The supply of homes for sale. Jessica Lautz, Deputy Chief Economist at the <em>National Association of Realtors</em> (NAR), <a href="https://finance.yahoo.com/news/housing-experts-revise-mortgage-rate-forecasts-for-remainder-of-2024-113354358.html" target="_blank" rel="noopener noreferrer">explains</a>:</p>

<p><em>“One thing that seems to be pretty solid is that home prices are going to continue to go up, </em><strong><em>and the reason is that we don&#8217;t have housing inventory</em></strong><em>.”</em></p>
</blockquote>
<p>While <a href="https://www.simplifyingthemarket.com/en/2024/05/16/the-number-of-homes-for-sale-is-increasing/?a=405191-bf9ce7799899cf839e0bf0e261497d3e" target="_blank" rel="noopener noreferrer">inventory is up</a> compared to the last couple of years, it’s still low overall. And because there still aren’t enough homes to go around, that’ll keep upward pressure on prices.</p>

<p>For 2024, the number of home sales will be about the same as last year and may even rise slightly. <p>The average of the three forecasts is about 5 million sales in 2024 – a small increase from 2023. Lawrence Yun, Chief Economist at NAR, <a href="https://www.nar.realtor/newsroom/pending-home-sales-ascended-3-4-in-march" target="_blank" rel="noopener noreferrer">explains why</a>:</p>

The graph below uses the latest <a href="https://www.realtor.com/research/data/" target="_blank" rel="noopener noreferrer">data</a> from <em>Realtor.com</em> to show in April 2024 there were more homes for sale than there were over the last few years (2021-2023):</p>

<p>There’s been a lot of recession talk over the past couple of years. And that may leave you worried we’re headed for a repeat of what we saw back in 2008. Here’s a look at the latest expert projections to show you why that isn’t going to happen.</p>
<p><a href="https://www.builderonline.com/data-analysis/how-the-election-and-unemployment-could-impact-the-2024-housing-market_c" target="_blank" rel="noopener noreferrer">According</a> to Jacob Channel, Senior Economist at <em>LendingTree</em>, the economy’s pretty strong:</p>
<blockquote>
<p><em>“At least right now, the fundamentals of the economy, despite some hiccups, are doing pretty good. While things are far from perfect, </em><strong><em>the economy is probably doing better than people want to give it credit for</em></strong><em>.”</em></p>
</blockquote>
<p>That might be why a <a href="https://www.wsj.com/economy/economic-forecasting-survey-archive-11617814998" target="_blank" rel="noopener noreferrer">recent survey</a> from the <em>Wall Street Journal</em> shows only 39% of economists think there’ll be a recession in the next year. That’s way down from 61% projecting a recession just one year ago (<em>see graph below</em>):</p>
<p><a href="https://files.keepingcurrentmatters.com/KeepingCurrentMatters/content/images/20240304/20240305-More-Economists-Now-See-a-Soft-Landing.png" target="_blank" rel="noopener noreferrer"><img decoding="async" src="https://files.keepingcurrentmatters.com/KeepingCurrentMatters/content/images/20240304/20240305-More-Economists-Now-See-a-Soft-Landing.png" alt="a graph of the economic growth of the economy" /></a></p>
<p>Most experts believe there won’t be a recession in the next 12 months. One reason why is the current unemployment rate. Let’s compare where we are now with historical data from <a href="https://www.macrotrends.net/countries/USA/united-states/unemployment-rate" target="_blank" rel="noopener noreferrer"><em>Macrotrends</em></a>, the <a href="https://www.bls.gov/news.release/pdf/empsit.pdf" target="_blank" rel="noopener noreferrer"><em>Bureau of Labor Statistics</em></a> (BLS), and <a href="https://tradingeconomics.com/united-states/unemployment-rate#:~:text=Unemployment%20Rate%20in%20the%20United,percent%20in%20May%20of%201953." target="_blank" rel="noopener noreferrer"><em>Trading Economics</em></a>. When we do, it’s clear the unemployment rate today is still very low (<em>see graph below</em>):</p>

<p>The orange bar shows the average unemployment rate since 1948 is about 5.7%. The red bar shows that right after the financial crisis in 2008, when the housing market crashed, the unemployment rate was up to 8.3%. Both of those numbers are much larger than the unemployment rate this January (<em>shown in blue</em>).</p>
<p>But will the unemployment rate go up? To answer that, look at the graph below. It uses data from that same <em>Wall Street Journal</em> <a href="https://www.wsj.com/economy/economic-forecasting-survey-archive-11617814998" target="_blank" rel="noopener noreferrer">survey</a> to show what the experts are projecting for unemployment over the next three years compared to the long-term average (<em>see graph below</em>):</p>

<p>As you can see, economists don’t expect the unemployment rate to even come close to the long-term average over the next three years – much less the 8.3% we saw when the market last crashed.</p>
<p>Still, if these projections are correct, there will be people who lose their jobs next year. Anytime someone’s out of work, that’s a tough situation, not just for the individual, but also for their friends and loved ones. But the big question is: will enough people lose their jobs to create a flood of foreclosures that could crash the housing market?</p>
<p><strong>Looking ahead, projections show the unemployment rate will likely stay below the 75-year average. That means you shouldn&#8217;t expect a wave of foreclosures that would impact the housing market in a big way.</strong></p>
<h3>Bottom Line</h3>
<p>Most experts now think we won&#8217;t have a recession in the next year. They also don&#8217;t expect a big jump in the unemployment rate. That means you don’t need to fear a flood of foreclosures that would cause the housing market to crash.</p></div>
